These terms explain how you may use carolyngillan.com (the “Website”). Please read them before using the Website. By using the Website, you agree to use it in accordance with these terms. If you do not agree with them, please stop using the Website.

1. About me

The Website is operated by Carolyn Gillan, trading as Carolyn Gillan Counselling & Hypnotherapy. I am a sole trader based in Plymouth, United Kingdom. In these terms, “I”, “me” and “my” refer to Carolyn Gillan.

2. What these terms cover

These terms apply to browsing and using the public parts of the Website and the general information made available through it.

Separate terms or agreements apply to:

• purchases, paid or free digital resources and other products offered through the Website, which are covered by my Terms & Conditions;
• counselling, hypnotherapy and other therapy services, which are covered by the agreement provided to therapy clients; and
• supervision services, which are covered by the agreement provided to supervisees.

If a separate agreement applies to a particular service or resource, that agreement will take priority in relation to that service or resource.

3. General information and professional relationships

The content on the Website is provided for general information and education. It is not personalised medical or mental-health advice and is not a substitute for an assessment, diagnosis or treatment from an appropriately qualified professional.

Using the Website, contacting me, joining my mailing list or accessing a free resource does not by itself create a therapist–client, supervisor–supervisee or other professional relationship. A professional relationship begins only when we have expressly agreed to work together and the relevant agreement has been accepted.

The Website is not an emergency or crisis service. If you or someone else is in immediate danger, call 999 or go to your nearest Accident & Emergency department.

I do not promise that any particular result will arise from using the Website or its general information. Please see my Disclaimer for further information.

4. Accuracy, availability and changes

I take reasonable care when preparing and updating the Website. However, information may become incomplete or out of date, and I do not promise that the Website will always be available or free from errors.

I may update, change, suspend or withdraw any part of the Website where reasonably necessary, including for maintenance, security, operational or legal reasons. Where practicable, I will try to minimise unnecessary disruption.

Where practicable, I will try to give reasonable notice of a substantial planned change that is likely to affect access to a resource made available through the Website, particularly where access was offered for a stated or time-limited period. Any rights relating to a paid or free digital resource are governed by my Terms & Conditions and the information provided when you obtained the resource.

If a public page, article or other item is archived or deleted, you should not assume that it or any link from it will remain available. Removing a page does not affect your right to retain and use a personal copy of a resource that you legitimately downloaded, subject to the licence and any stated access period in my Terms & Conditions. It does not, however, guarantee continuing access to an expired link, an archived page or content that was only available online for a limited period.

• use the Website unlawfully, fraudulently or in a misleading way;
• knowingly introduce viruses, malicious code or other technologically harmful material;

• use the Website or its content in a way that infringes another person’s rights.

I may restrict or block access where I reasonably believe that the Website is being misused. Suspected unlawful activity may be reported to the relevant authorities.

Unless stated otherwise, I own or license the copyright and other intellectual property rights in the Website and its content. Third-party material remains the property of its respective owner.

You may view the Website and print or download reasonable extracts for your personal, non-commercial use. You may also link to a public page of the Website, provided that the link is fair and lawful and does not falsely suggest that I endorse, approve of or am associated with you or your organisation.

I do not control third-party websites. I am not responsible for loss or damage caused by a third party’s acts, omissions or failure to provide its website or service, except where the law provides otherwise.

8. Personal information and cookies

Information you send through a form or by email is not published as user content. I handle personal information in accordance with my Website Privacy Notice and, where applicable, my Therapy Client Privacy Notice or Supervision Privacy Notice.

9. Responsibility for loss or damage

Nothing in these terms excludes or limits liability where doing so would be unlawful. This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, and your statutory consumer rights.

I am responsible for loss or damage that is a foreseeable result of my breach of these terms or my failure to use reasonable care and skill. I am not responsible for loss or damage that is not foreseeable, is not caused by my breach, or results from circumstances outside my reasonable control.

The general information on the Website is not prepared for your individual circumstances. I am therefore not responsible for decisions made solely in reliance on that general information where appropriate personalised professional advice should reasonably have been obtained.

If you use the Website wholly or mainly for a business or professional purpose, I will not be responsible for loss of profit, business, revenue, anticipated savings, business opportunity or goodwill, except where such liability cannot lawfully be excluded.
